General Terms and Conditions
ROUSSELINE | Sarah Valeria D GmbH
As of: 12 October 2026
§ 1 Scope and Contracting Parties
- These General Terms and Conditions apply to all contracts for the purchase of goods concluded between Sarah Valeria D GmbH, trading under the ROUSSELINE brand, and consumers via the online shop at https://rousseline.com.
- Contracting party: Sarah Valeria D GmbH, ROUSSELINE, Riedlstr. 3, 80538 Munich, Germany; email: hello@rousseline.com.
- A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity (Section 13 of the German Civil Code (BGB)).
- These Terms and Conditions apply to regular fashion items, accessories, limited collections and products expressly designated as pre-orders.
§ 2 Conclusion of Contract
- The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
- Customers may add products to their shopping cart and review and correct their information before submitting an order.
- By clicking the “Order with obligation to pay” button or another button clearly indicating the obligation to pay, the customer submits a binding offer to conclude a purchase contract.
- After the order is received, the customer receives an automated order confirmation by email. This order confirmation also constitutes acceptance of the customer’s offer by ROUSSELINE. The purchase contract is concluded when the customer receives this email. No separate order acceptance confirmation is sent.
- A mere payment confirmation does not constitute acceptance of the contract unless acceptance is expressly declared therein.
- The contractual language is English.
- The customer receives the contractual provisions, including these Terms and Conditions, as a PDF with the order confirmation email. Order details are stored and can be accessed through the customer’s account.
§ 3 Products and Limited Collections
- ROUSSELINE sells clothing, fashion items and accessories in particular.
- Individual products may be offered as limited collections, exclusive drops or pre-orders.
- The essential characteristics of the products are set out in the respective product descriptions.
- For limited collections, there is no entitlement to renewed availability or further production.
- Technical differences in how colors are displayed on screens may occur. The contractually agreed product characteristics and statutory rights in the event of defects remain decisive.
§ 4 Pre-Orders and Advance Orders
- Products marked “Pre-Order” are not ready for immediate dispatch at the time of ordering.
- The agreed delivery period for pre-orders is generally 4 to 6 weeks from conclusion of the contract. Any different binding delivery periods will be expressly stated on the relevant product page and before the order is completed.
- The full purchase price for pre-orders is payable immediately upon ordering, unless the selected payment method provides otherwise.
- Production or procurement of a pre-order product may begin only after orders have been received.
- In the event of delivery delays, the customer will be informed without undue delay. Such notification does not automatically change the agreed delivery period.
- The customer’s statutory rights in the event of delayed delivery, non-delivery or impossibility of performance remain fully unaffected.
- As a rule, the statutory right of withdrawal applies to pre-orders. Production after an order is placed or a limited quantity alone does not exclude the right of withdrawal.
- Statutory exceptions to the right of withdrawal may apply to products individually made to customer specifications, provided the relevant conditions are met.
§ 5 Prices and Payment Terms
- The prices displayed in the online shop at the time of ordering apply.
- Prices include legally applicable value-added tax, where applicable.
- Any additional shipping costs will be indicated before the order is completed.
- Available payment methods include Visa, Mastercard, American Express, Maestro, UnionPay, Apple Pay, Google Pay, Shop Pay, Klarna, Bancontact, eps, MB WAY and MobilePay, as well as other local payment methods displayed at checkout. The payment methods available for a particular order are shown at checkout.
- For pre-orders, payment is generally made in advance.
- For international orders, banks or payment service providers may charge currency conversion fees.
- The tax treatment of international orders is governed by the applicable statutory provisions.
§ 6 Shipping and Delivery
- ROUSSELINE offers worldwide shipping to the countries selectable at checkout, provided there are no legal or practical shipping restrictions.
- Delivery is made to the delivery address specified by the customer.
- Delivery times are stated on the relevant product pages or during the ordering process.
- For pre-orders, the delivery period is generally 4 to 6 weeks from conclusion of the contract unless a different delivery period has been agreed.
- Shipping costs are displayed before the order is completed.
- Deliveries to countries outside the European Union may incur import duties, import VAT and other official charges.
- To the extent legally permissible and disclosed accordingly before conclusion of the contract, the customer bears these import charges. Delivery in this respect is made on a Delivered at Place (DAP) basis.
- If import charges cannot be calculated in advance, the customer will be informed before conclusion of the contract that such charges may arise.
- As a rule, the risk of accidental loss of or accidental damage to the goods passes only when the goods are handed over to the customer or a person authorized by the customer to receive them.
- Statutory claims in the event of delayed delivery or non-delivery remain unaffected.
§ 7 Right of Withdrawal
- Consumers generally have a statutory right of withdrawal of 14 days for distance contracts.
- For a purchase contract concerning a single item, the withdrawal period generally begins upon receipt of the goods.
- If several items in a single order are delivered separately, the withdrawal period generally begins upon receipt of the last item.
- The statutory right of withdrawal generally also applies to pre-orders and limited collections.
- Details on exercising the right of withdrawal, applicable periods and legal consequences are set out in the separate withdrawal instructions, including the model withdrawal form.
- Statutory exceptions to the right of withdrawal remain unaffected.
§ 8 Returns and Refunds
- When exercising the statutory right of withdrawal, the customer bears the direct costs of returning the goods, provided they were properly informed of this before conclusion of the contract.
- Return address: Sarah Valeria D GmbH – ROUSSELINE Returns, Lilienthalstraße 8, 85399 Hallbergmoos, Germany.
- In the event of statutory withdrawal, the customer must return the goods within the statutory period.
- Refunds will be made within the statutory time limits and generally using the same payment method used for the original transaction, unless expressly agreed otherwise.
- Under the statutory conditions, ROUSSELINE may withhold the refund until the goods have been received back or the customer has provided proof of return shipment, whichever occurs first.
- The customer is liable for any loss in value of the goods only if it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods and the statutory conditions are met.
- A return under the statutory right of withdrawal is not necessarily conditional on the presence of the original packaging or original tags.
- Statutory claims relating to defective or incorrectly delivered goods remain unaffected.
- For returns from non-EU countries, any required customs formalities must be observed. Mandatory statutory consumer rights remain unaffected.
§ 9 Retention of Title
- The delivered goods remain the property of Sarah Valeria D GmbH until the purchase price has been paid in full.
§ 10 Statutory Liability for Defects
- Statutory rights in the event of defects apply to all goods offered.
- In the event of a material defect or defect in title, the customer is entitled to statutory remedies, in particular subsequent performance and, subject to statutory requirements, withdrawal from the contract, reduction of the purchase price or damages.
- These Terms and Conditions do not restrict statutory rights in the event of defects.
- Voluntary guarantees apply only where expressly offered for the respective product.
§ 11 Liability
- ROUSSELINE is liable without limitation in cases of intent and gross negligence and for culpably caused damage resulting from injury to life, limb or health.
- In the event of a slightly negligent breach of material contractual obligations, liability is limited to damage typical of the contract and foreseeable. Material contractual obligations are obligations whose fulfillment enables the proper performance of the contract and on whose observance the customer may regularly rely.
- Otherwise, liability for damage caused by slight negligence is excluded to the extent permitted by law.
- Liability under the German Product Liability Act, under guarantees assumed and under mandatory statutory provisions remains unaffected.
§ 12 Customer Service and Contact
- Our customer service team is available for questions about products, orders, deliveries and complaints: ROUSSELINE, Sarah Valeria D GmbH, Riedlstr. 3, 80538 Munich, Germany; email: hello@rousseline.com; website: https://rousseline.com.
- The exercise of statutory consumer rights is not conditional on prior contact with customer service.
§ 13 Consumer Dispute Resolution
- Sarah Valeria D GmbH is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body, unless participation is required by law.
§ 14 Applicable Law
- The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
- For consumers habitually resident outside Germany, mandatory consumer protection provisions of the country of their habitual residence remain unaffected insofar as they apply under the relevant conflict-of-laws rules.
- Statutory provisions govern jurisdiction.
§ 15 Final Provisions
- Individual agreements between ROUSSELINE and the customer take precedence over these Terms and Conditions.
- If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions remains unaffected in accordance with statutory provisions.
